1. Membership application and eligibility
- You must provide information that is true, accurate, complete, and not misleading.
- An application does not guarantee membership. Onyx may accept or decline an application at its discretion, subject to applicable law.
- You must be at least 18 and legally capable of entering this agreement. Members aged 14–17 may join only with written consent and signed participation by a parent or legal guardian.
- Membership is personal and non-transferable. Access cards, codes, and other credentials must not be shared, sold, lent, or transferred.
- Onyx may suspend or terminate membership for a breach of these terms, the House Rules, or another applicable Onyx policy.
2. Fees, cancellations, refunds and pauses
- Fees are payable according to the selected plan and the price applicable at enrolment.
- Cancellations, refunds, transfers, freezes, and pauses follow the policies communicated at enrolment or subsequently updated by Onyx.
- Unless required by law or expressly allowed by an applicable Onyx policy, fees are non-refundable after the membership period begins.
- Onyx may update pricing, policies, services, operating hours, classes, and facilities from time to time.
3. Assumption of risk and health responsibility
Fitness and wellness activities involve inherent risks, including strains, sprains, fractures, cardiovascular events, equipment injuries, slips and falls, dehydration, heat-related illness, class-related injuries, wellness-facility risks, and exposure to communicable illness.
- You voluntarily assume the risks associated with participating in fitness activities and using Onyx facilities.
- You must follow safety instructions, equipment guidance, staff directions, signage, and facility rules.
- You are responsible for consulting a qualified medical professional before beginning or significantly changing an exercise programme, particularly if you have a medical condition, injury, disability, or other health concern.
- You should inform Onyx of relevant conditions or limitations where appropriate and must not undertake activities a qualified professional has advised you to avoid.
- Fitness, training, wellness, and nutrition guidance from Onyx is general information—not medical advice, diagnosis, or treatment.
Health information and emergency-contact details may be provided voluntarily during in-person onboarding. Leaving optional health fields blank does not affect membership.
4. Limitation of liability
To the fullest extent permitted by Kenyan law, Onyx and its directors, employees, contractors, coaches, agents, and representatives are not liable for injury, illness, loss, damage, or death arising from facility use, fitness activities, classes, equipment, events, or the risks of a shared fitness environment.
Nothing in these terms excludes or limits liability where Kenyan law prohibits doing so. You must use equipment and facilities responsibly and as instructed.
5. Independent coaches and third-party services
Some coaches, trainers, instructors, medical partners, or other service providers may be independent contractors rather than Onyx employees. When you independently engage a third party, Onyx is not responsible for that provider’s services, advice, conduct, acts, or omissions except where required by law. You are responsible for confirming their terms, fees, and arrangements.
6. Personal property and communicable illness
- You are responsible for belongings brought onto Onyx premises. Use available lockers and avoid bringing unnecessary valuables.
- A shared fitness environment carries a risk of communicable illness. Do not attend when you know you may pose a significant transmission risk.
- Onyx may introduce reasonable health, hygiene, and safety measures.
7. Photography and media
Onyx may occasionally create photographs or video in the facility for communications and brand purposes. Media consent is optional and does not affect eligibility, access, pricing, or service quality. During onboarding you may choose full consent, background-only consent, or no consent.
You may change or withdraw consent by contacting Onyx management. We will take reasonable steps to honour withdrawal, although material already published or distributed may not always be capable of complete removal.
8. Onyx Fitness House Rules
- Treat members, coaches, staff, contractors, and visitors with respect.
- Aggressive, threatening, abusive, discriminatory, or harassing conduct is prohibited.
- Serious or repeated violations may result in suspension or termination, without refund where appropriate and lawful.
- Re-rack weights, return equipment, and wipe down equipment where cleaning facilities are provided.
- Wear appropriate athletic clothing and clean training shoes.
- Use equipment safely and only for its intended purpose.
- Do not photograph or film other members without their permission. Personal training footage remains subject to facility restrictions.
- Keep phones silent on the training floor and take calls in appropriate areas.
- Do not share membership credentials.
- Follow staff directions, signage, safety instructions, equipment instructions, and applicable policies.
- Comply with applicable cancellation, refund, transfer, and pause policies.
- You may be responsible for repair or replacement costs for deliberate damage or serious misuse, subject to law.
9. Data protection
Onyx processes personal data in accordance with the Kenya Data Protection Act, 2019 and applicable law. Please read our Privacy Policy for the categories of data, purposes, sharing, retention, rights, and optional consents.
10. Declaration, governing law and jurisdiction
By accepting these terms, you confirm that your information is accurate; you understand the risks and health responsibilities of exercise; you accept the lawful liability limitations; and you agree to follow Onyx policies, House Rules, and reasonable instructions.
These terms are governed by the laws of the Republic of Kenya. A dispute that cannot be resolved amicably is subject to the jurisdiction of the courts of Kenya.
